The Selling Process

Market valuation
One of our sales team will visit your property to determine its market value, discuss a marketing strategy, and explain our fees and terms of business.

Prepare your property for viewings
Presenting your property in its best possible condition will assist greatly in achieving a speedy sale at a market price. Good first impressions are all important. Further down this page we provide some guidance and tips on preparing and presenting your property in the best possible way.

Marketing the property
Once we have obtained relevant details and taken pictures of your property, we will prepare marketing material and request your approval. We would usually then market your property on our website, on property portal sites, and by telephone and mail to suitable waiting purchasers on our books.

The viewings
A member of our sales team are happy to meet prospective purchasers at your property and show them around. However owners can carry out the viewings if this is their preference.

Receiving offers
All offers received will be notified to you both by telephone and in writing. As part of our service we will negotiate between yourself and the purchaser to arrive at a mutually agreed sale price.

Instruct a solicitor
It is at this point that you should instruct your solicitor or conveyancer to act for you and liaise with the purchaser's solicitor. If required Owen Lyons has several reputable solicitors that we are happy to recommend.

Legal work
We will prepare a memorandum of sale, and send it to all parties concerned. Upon receipt your solicitor will prepare a draft contract and send it to the purchaser's solicitor, who will then make preliminary enquiries, conduct local and land registry searches, and once enquiries are complete, approve the draft contract.

Progressing the sale
As part of our service, during these processes we will keep in regular contact with all parties, ensure that any queries are ironed out, and generally work towards keeping the wheels turning towards a smooth completion.

Exchange of Contracts
Once the legal preliminaries are completed and paperwork prepared, and the purchaser has the necessary finance offer in place, contracts of sale are signed and exchanged, and a deposit usually 10% of the sale price is paid by the purchaser. At this point a date for completion will be agreed.

Completion of sale
Completion takes place when the balance of the purchase price is received, and ownership of the property is transferred. Keys will be handed in to our office, and passed on to the happy purchaser.

Energy Performance Certificates For Sale Properties (EPCs)
Before marketing a property for sale, you must commission an Energy Performance Certificate (EPC). An EPC tells you and the prospective buyer how energy efficient your property is, the impact the property has on the environment, and includes recommendations on ways to improve the property's energy efficiency. You can start marketing your property before the EPC is ready, but it must be made available and added to all marketing material within 28 days. EPCs can only be produced by accredited Domestic Energy Assessors. Please find information below for the cost of an EPC.

Selling Fees

Sales Fees
Our fees remain as competitive as possible without compromising our high standards of service. As a general guide our standard fees are listed below. We would urge vendors thinking of selling a property to contact our sales department to discuss in more detail the various fee and service options available.

Sole Selling Rights*
Whilst operating under sole selling rights Owen Lyons will be the only agents* for a period of 12 weeks from the date of any signed agreement. Please note that you may have the right to cancel this contract (via written notice) under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 within a 14 calendar day cooling off period from the date upon which it was signed.

Energy Performance Certificates (EPC)
The law requires the vendor’s of a property to obtain an Energy performance certificates (EPC) before a property can be shown for sale. We can arrange for an Energy performance certificates (EPC) to be carried out on your behalf, if you do not already have an Energy performance certificates (EPC) for the fee of £84.00 including VAT.

Amount of Fees

Owen Lyons standard sales fee is 1.2% inclusive of VAT, this is calculated on the eventual contractual sale price of the property. Should the contractual sale price be higher or lower than the asking price, our fee will be correspondingly higher or lower.

**Please note all agency commissions are subject to a minimum fee of £2,640 inclusive of VAT.

All fees arise on exchange of contracts and are payable upon the contractual completion date.

The fees cover all charges including advertising and promotional cost, other than any special expenditure, details of which will be notified to you in advance of you incurring any liability in respect of the same, and which are specifically and separately agreed with you and put in writing to you.

Referral Fees

Under the consumer protection for Unfair Trading Regulations issued by Trading Standards, Owen Lyons are required to be transparent and disclose referral fees.

Solicitors - If you choose to instruct one of our recommended Solicitors for their legal services, a referral fee of up to £180 including vat will be paid to Owen Lyons for the introduction. Any such referral fees that are offered to us will be disclosed to our customer at the point of sale. Owen Lyons do not receive retainer referral payments from any additional service providers.

SJB Financial Ltd commission rates to Owen Lyons - Owen Lyons have an introducer agreement with SJB Financial Ltd, the agreement is made in accordance with rules of the Financial Conduct Authority (FCA). The Advisor is part of Mortgage Intelligence Limited which is regulated by the FCA to carry out mortgage and non-investment insurance business.

It is agreed that the Advisor shall pay Owen Lyons 30% of the net initial commissions received by the Advisor from any insurance provider, mortgage lender or client for business transacted on behalf of the introduced customer. The Introducer’s remuneration becomes due upon receipt of cleared funds by the Advisor.
